Agreement
All users (Travel Agents and Travel Agencies) of TRAVELAGENTSPECIALS.COM are required to agree to the following Terms and Conditions.   Anyone determined by TRAVELAGENTSPECIALS.COM to have violated these terms and conditions is subject to being banned from TRAVELAGENTSPECIALS.COM without any obligation by TRAVELAGENTSPECIALS.COM or its parent company Creative NetVentures, Inc.

Exclusive Use
TRAVELAGENTSPECIALS.COM is for the exclusive use of Travel Agencies and Travel Agents.  The following types of sites are NOT allowed to use TRAVELAGENTSPECIALS.COM for any reason:  Sites containing pornographic material, sites with links to pornographic sites, sites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites engaged in libelous or harassing activities, sites that promote or utilize software or services designed to deliver unsolicited e-mail, sites that are otherwise inappropriate.  TRAVELAGENTSPECIALS.COM reserves the right, in its sole discretion, to determine whether an Agent may use TRAVELAGENTSPECIALS.COM.

Ownership and Rights
TRAVELAGENTSPECIALS.COM retains ownership and all rights to the TRAVELAGENTSPECIALS.COM name, logo, software, web site, and related proprietary information.  Registered agents and agencies with TRAVELAGENTSPECIALS.COM may not
use the TRAVELAGENTSPECIALS.COM name and likeness for monetary gain or profit outside of the rights outlined in this agreement.
 
Publicity Rights
Users acknowledge and agree that their web site information (name, URL) and travel specials will be displayed on TRAVELAGENTSPECIALS.COM.  Possible uses include (but are not limited to) promoting your travel specials and details pertaining to published travel specials for the purpose of promoting your agency's services and offerings.   Users agree to allow TRAVELAGENTSPECIALS.COM to use screen shots and site names of any web page that uses the TRAVELAGENTSPECIALS.COM service in TRAVELAGENTSPECIALS.COM promotional materials.

Liability
All users agree to utilize the services of TRAVELAGENTSPECIALS.COM at their own risk. TRAVELAGENTSPECIALS.COM, its administrators, partners and sponsors cannot be held liable for any damage or loss of information that may occur from the use of the services of TRAVELAGENTSPECIALS.COM. TRAVELAGENTSPECIALS.COM is protected from network outages with redundant T3 connectivity to the internet.   TRAVELAGENTSPECIALS.COM is protected from power outages with electric generators and other backup systems.  Although we will make a reasonable effort to provide a very high standard of quality for our services, TRAVELAGENTSPECIALS.COM makes no guarantees of any kind regarding the dependability or timeliness of the services of TRAVELAGENTSPECIALS.COM.

Intellectual Property
The information provided by TRAVELAGENTSPECIALS.COM to its users may be proprietary in nature. TRAVELAGENTSPECIALS.COM users acknowledge that they are not competitors of TRAVELAGENTSPECIALS.COM, and agree not to share this information with any competitors.  Anyone found deliberately copying intellectual property from this website will be prosecuted to the fullest extent of international law.

Spam
The TRAVELAGENTSPECIALS.COM database is monitored very closely, both by humans and automated software.  Any agency or agent caught attempting to spam the database shall be banned from TRAVELAGENTSPECIALS.COM indefinitely.

Bait and Switch
TRAVELAGENTSPECIALS.COM listens to its users and provides a method of allowing the public end user to provide feedback regarding any agent or agency's travel specials listed in the TRAVELAGENTSPECIALS.COM database.  Any agency suspected of repeatedly listing a product or service on TRAVELAGENTSPECIALS.COM for a specific price, and then not offering the user the published price (bait and switch) will be banned from TRAVELAGENTSPECIALS.COM indefinitely. 

Indemnification
You agree to defend, indemnify and hold TRAVELAGENTSPECIALS.COM and it's parent company Creative NetVentures, Inc. harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys' fees) arising from your violation of this Agreement or any third-party's rights, including but not limited to infringement of any copyright, violation of any proprietary right and invasion of any privacy rights. This obligation will survive any termination of this Agreement.
